Resumo Omnilex

The Federal Administrative Court upheld the third party’s complaint against the non-admission of revision. It held that the case has fundamental significance because it can clarify whether the Telecommunications Act grants the Federal Network Agency a margin of assessment when determining the costs of efficient service provision, particularly as to the hourly rates used for one-time charges. The court also stated that the dispute is suitable for clarifying the standard of judicial review. Costs were addressed only through the statutory fee references.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; fundamental significance of the case in telecom fee regulation. Revision is to be admitted where the appeal proceedings can clarify whether the Telecommunications Act leaves the regulatory authority a margin of assessment in determining costs of efficient service provision, in particular as to hourly rates forming the basis of one-time charges, and which standards govern judicial review of that assessment (consid. 1).
