Resumo Omnilex

The Federal Administrative Court admitted the revision on the plaintiff’s complaint against the Administrative Court of Greifswald. The court considered that the case raises clarifiable questions of law about whether a former mineral extraction right, transformed by the Unification Treaty into a mineral resource under the Federal Mining Act, is an asset under the VermG, and whether mining property retained for the Treuhandanstalt constitutes an equivalent right that can be returned under the VermG. It also noted the question whether restitution is excluded by the nature of the matter.

Sumário Omnilex

Art. 8 EinigVtr, § 3 Abs. 3 BBergG, § 2 Abs. 2 VermG, § 4 Abs. 1 S. 1 VermG, § 6 Abs. 6a VermG; admissibility of revision in a restitution dispute concerning mineral extraction rights and mining property. Revision is to be admitted where unresolved questions of federal law arise as to whether a former grundeigenes Abbaurecht transformed into bergfreier Bodenschatz constitutes a Vermögenswert and whether Bergwerkseigentum retained under the Unification Treaty is to be treated as an essentially equivalent, returnable asset. The decision emphasizes that the revision procedure may clarify whether restitution is excluded by the nature of the matter (consid. 1).
