Resumo Omnilex

The Federal Administrative Court granted the plaintiff’s complaint and admitted the revision. It held that the case raises a question of fundamental importance, namely whether a reimbursement dispute between a social welfare authority and an educational assistance office requires an application within the meaning of § 46 BAföG. The court did not decide that substantive question at this stage; it only found that clarification in revision proceedings was warranted.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance in a reimbursement dispute concerning § 46 BAföG. A revision is to be admitted if the case gives rise to a legally significant, unresolved question of general importance that is capable of clarification in the revision proceedings. This is so where it must be determined whether, in a reimbursement dispute between a social welfare authority and an educational assistance office, an application requirement exists under § 46 BAföG. The admissibility threshold is met even though the substantive question itself remains open at the stage of leave to appeal (consid. 1).
