Gründe

1 Die zulässige Beschwerde ist begründet. Die Revision ist wegen grundsätzlicher Bedeutung der Rechtssache (§ 132 Abs. 2 Nr. 1 VwGO) zuzulassen. Das Revisionsverfahren kann dem Senat voraussichtlich Gelegenheit geben, den Begriff des Abfallerzeugers (§ 3 Abs. 5 KrW-/AbfG, § 3 Abs. 8 KrWG) zu klären.

2 Die Streitwertfestsetzung für das Beschwerdeverfahren folgt aus § 47 Abs. 1 i.V.m. § 52 Abs. 1 GKG, für das Revisionsverfahren aus § 47 Abs. 1 i.V.m. § 52 Abs. 1 und § 63 Abs. 1 GKG.
