Resumo Omnilex

The Federal Administrative Court allowed the complaint against the Lower Saxony Higher Administrative Court judgment. It held that the matter has fundamental significance because the revision is expected to clarify whether, under Article 12(1) of Regulation (EC) No. 796/2004, the single application must include documents proving the information needed to determine aid eligibility.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; leave to appeal for fundamental importance is justified where the revisional court must clarify an unresolved question of federal or Union law decisive for the dispute. Art. 12 Abs. 1 VO (EG) Nr. 796/2004 may require, in connection with the single application, submission of documents containing the information necessary to establish aid eligibility; if this interpretative question is open and decisive, fundamental significance exists (consid. 1).
