Resumo Omnilex

The Federal Administrative Court upheld the defendant's complaint against non-admission of revision. It found that the case has fundamental importance because it requires clarification of when parents can invoke their constitutional right to raise a child in religious matters to obtain an exemption from participation in a school event. The court therefore admitted revision under § 132(2) No. 1 VwGO.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a case concerning exemption from participation in a school event on religious grounds; revision is to be admitted where the dispute raises an unresolved question of law requiring further clarification for uniform application of the law. The parents’ right to child-rearing in religious matters under Art. 6 Abs. 2 sentence 1 in conjunction with Art. 4(1) GG may, depending on the circumstances of the individual case, give rise to an exemption claim; the existence and scope of such a claim is capable of establishing grundsätzliche Bedeutung (consid. 1).
