§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a legal question concerning equal opportunity and subsidy allocation: A complaint against denial of revision is well founded where, in the intended revision proceedings, a clarifiable and decisive question arises as to whether the principle of equal opportunity precludes, in all cases or under certain conditions, a distribution of funds for financing the administrative business of council factions based exclusively on faction strength. The scope of the remedy is determined by the objectively ascertainable intent of the appellant; where the pleading attacks only one defendant, it is to be construed accordingly (consid. 1-2).

Gründe

1 Die Klägerin wendet sich mit der Beschwerde ausschließlich gegen die Abweisung ihrer Klage gegen die Beklagte zu 2. Der Senat legt die Rechtsmittelschrift deshalb dahin aus, dass sich das Rechtsmittel nur gegen die Beklagte zu 2 richtet.

2 Die Beschwerde ist begründet. Der Rechtssache kommt grundsätzliche Bedeutung gemäß § 132 Abs. 2 Nr. 1 VwGO zu. In einem Revisionsverfahren ist voraussichtlich die in der Beschwerdebegründung sinngemäß aufgeworfene Frage zu klären, ob der Grundsatz der Chancengleichheit stets oder unter bestimmten Voraussetzungen einer ausschließlich nach der Fraktionsstärke bemessenen Verteilung der Zuwendungen zur Finanzierung der Geschäftsführung der Ratsfraktionen entgegensteht.

3 Die Streitwertfestsetzung ergibt sich aus § 47 Abs. 1 und 3, § 52 Abs. 1, § 63 Abs. 1 Satz 1 GKG.
