Resumo Omnilex

The Federal Administrative Court admitted revision against a judgment of the Hamburg Higher Administrative Court because the case raises a question of fundamental significance: whether a weapons and ammunition possession ban under § 41(2) WaffG may also be ordered for future possession. The decision also contains the provisional value-in-dispute determinations for the complaint and revision proceedings under the GKG.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility based on fundamental significance: Revision is to be allowed where the case presents a question of law not yet sufficiently clarified in the Federal Administrative Court’s case law and capable of contributing to clarification in the revision proceedings. Here, the unresolved issue whether a weapons and ammunition possession ban under § 41 Abs. 2 WaffG may also be ordered prospectively justifies admission (consid. 1).

§ 63 Abs. 1 Satz 1 GKG.
