1 Die Revision ist wegen grundsätzlicher Bedeutung der Rechtssache (§ 132 Abs. 2 Nr. 1 VwGO) zuzulassen. In einem Revisionsverfahren kann die Frage geklärt werden, ob und unter welchen Voraussetzungen eine immissionsschutzrechtliche Freistellungserklärung nach § 15 Abs. 2 Satz 2 BImSchG Rechte eines Dritten verletzen und ein nachbarliches Abwehrrecht zur Folge haben kann.
