Resumo Omnilex

The Federal Administrative Court held that the complaint against non-admission of revision was admissible and well-founded because the case raises a question of fundamental importance: whether a co-determination procedure completed only later for working-time regulations can justify retroactive further reduction of a part-time civil servant’s salary. The excerpt does not contain the full dispositive wording beyond the finding that the complaint is well-founded.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a complaint against non-admission of revision. A question is of fundamental importance when it concerns an unresolved, legally relevant issue capable of clarification in revision and material to the contested judgment. This may be the case where it is disputed whether the subsequent completion of a mandatory co-determination procedure in relation to working-time regulations can retroactively justify a further reduction in the remuneration of part-time civil servants (consid. 1).
