Resumo Omnilex

The Federal Administrative Court upheld the complaint and allowed the revision. It held that the case raises a question of fundamental importance: whether an omitted or defective FFH preliminary assessment can constitute a procedural error under § 4(1) no. 3 or § 4(1a) UmwRG. The decision contains only the leave-to-appeal ruling and an ancillary statement on the statutory basis for the amount in dispute.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; leave to appeal on the basis of fundamental importance: revision may be admitted where the proceedings are likely to clarify whether an omitted or defective FFH preliminary assessment can constitute a procedural defect within the meaning of § 4 Abs. 1 no. 3 or § 4 Abs. 1a UmwRG. It is sufficient that the question is capable of clarification in the revision proceedings; a conclusive substantive answer is not required at the admissibility stage (consid. 1).
