The Federal Administrative Court upheld the defendant’s complaint and admitted the revision. The decisive issue was whether, in planning a road, future developments in the road network are foreseeable and must therefore be included in the traffic prognosis. A legal question is of fundamental importance where its answer is open and capable of general clarification by the court of revision. In traffic-forecast disputes concerning planned roads, the question when future developments in the road network are to be regarded as foreseeable and therefore to be included in the prognostic assessment may justify admission of revision if it requires further doctrinal clarification. The provisional determination of the amount in dispute follows the GKG provisions cited in the decision.

Gründe

1 Die Beschwerde des Beklagten, mit der er die Zulassung der Revision begehrt, soweit die Klage nicht bereits abgewiesen worden ist, ist zulässig und begründet. Die Revision ist gemäß § 132 Abs. 2 Nr. 1 VwGO wegen grundsätzlicher Bedeutung der Rechtssache zuzulassen. Sie kann dem Bundesverwaltungsgericht Gelegenheit geben zur weiteren Klärung der Frage, ab wann zukünftige Entwicklungen im Straßennetz als vorhersehbar anzusehen und deshalb bei der Verkehrsprognose für eine geplante Straße zu berücksichtigen sind.

2 Die vorläufige Festsetzung des Streitwerts für das Revisionsverfahren folgt aus § 47 Abs. 1 Satz 1, § 52 Abs. 1, § 63 Abs. 1 Satz 1 GKG.
