Resumo Omnilex

The Federal Administrative Court granted the complaint and allowed the revision. It held that the case raises a question of fundamental importance: whether a special area under § 11(1) BauNVO may validly be designated for a combination of permanent residence and holiday residence. The court also noted that the provisional value in dispute for the revision proceedings was to be set under the GKG provisions cited in the decision.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility for fundamental importance; a complaint is well founded where the case is capable of clarifying a legally fundamental question. A revision may be admitted if the appeal proceedings are likely to resolve an unresolved issue of general significance. This is the case here with respect to whether § 11 Abs. 1 BauNVO permits the designation of a special area combining permanent residence and holiday residence (consid. 1).
