Resumo Omnilex

The Federal Administrative Court admitted the revision. The decisive issue was whether, in a sustained low-interest environment, a deferred repayment amount may still be subject to 4% interest. The court noted the absence of supreme-court guidance and divergent decisions among the higher administrative courts. It also provisionally fixed the amount in dispute for the revision proceedings under the GKG provisions cited in the order.

Sumário Omnilex

Revision admission; 4% interest on deferred repayment amounts in a prolonged low-interest environment. A revision is to be admitted where the legal question is of fundamental importance and has not yet been clarified by the highest court, especially if the lower-instance case law is divergent (consid. 1-2). The provisional value of the subject matter is to be determined according to § 63 para. 1 sentence 1 in conjunction with § 43 para. 2 and § 52 para. 3 sentence 1 GKG (consid. 3).

Titelzeile

OVG Weimar, Urteil vom 12. November 2015 - 2 KO 171/15 - juris Rn. 33 einerseits, OVG Münster, Urteil vom 24. Februar 2016 - 1 A 335/14 - juris Rn. 75 ff. andererseits).

Whether revision should be admitted on the legality of charging 4% interest on a deferred repayment amount during a historically low interest period.

Decisão extraída

The court admitted the revision because the legal question is of fundamental importance and has not yet been answered by the highest court; appellate courts have treated it differently.

Fundamentação extraída

There is no supreme court case law on the issue, and the administrative appellate courts are divided on whether a 4% interest rate remains permissible under persistent low-interest conditions.
