Resumo Omnilex

The Federal Administrative Court granted leave to appeal. It held that the case has fundamental significance because revision proceedings can clarify what requirements a member-state opt-out rule for voluntary overtime in fire service work must satisfy under Article 22(1) of Directive 2003/88/EC.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility for fundamental significance; a complaint is to be allowed where the case is suitable to clarify a legally open question of general importance. This is so in particular where the decisive issue concerns the requirements of a member-state opt-out rule under Art. 22(1) of Directive 2003/88/EC for voluntary additional work beyond the 48-hour weekly working-time limit (consid. 1).
