Resumo Omnilex

The Federal Administrative Court admitted the revision in a case concerning whether a member state may validly structure an opt-out arrangement for voluntary overtime in fire service shift work beyond 48 hours per week. The Court held that the legal question has fundamental importance and that the revision proceedings are suitable to clarify the requirements under Article 22(1) of Directive 2003/88/EC. No substantive merits decision was taken.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance concerning Article 22(1) of Directive 2003/88/EC and a national opt-out rule for voluntary overtime in fire service shift work beyond 48 weekly hours. Fundamental importance exists where the case raises a legally significant, unresolved question of union-law-conforming organization of working time that is suitable for clarification in revision proceedings. It is sufficient that the appeal identifies a concrete, reviewable question whose answer may have significance beyond the individual case; the revision court need not decide the merits at the admission stage.
