Resumo Omnilex

The Federal Administrative Court upheld the complaint against the denial of leave to appeal on a point of law. It held that the case is of fundamental importance because revision may clarify whether, and under what conditions, police overview video recordings made in advance of an assembly constitute an interference with freedom of assembly under Article 8(1) GG. The court also set the provisional and final costs-related dispute values for the complaint and revision proceedings.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility on fundamental importance; police overview recordings before an assembly. A matter has fundamental importance if it is capable of clarifying an unresolved, general legal question that is decisive for the dispute. This is also the case where the appeal proceedings can clarify whether and under what conditions preventive police overview recordings in the run-up to an assembly constitute an interference with freedom of assembly under Art. 8(1) GG (consid. 1). Cost-value determinations follow §§ 47, 52, 63 GKG according to the respective procedural stage.
