Resumo Omnilex

The Federal Administrative Court admitted the plaintiff's revision. It held that the case is of fundamental importance because it may clarify legal questions concerning compensatory time off for overtime in the form of standby duty, especially where the service was performed abroad. The court noted that related revision proceedings on these questions are already pending.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance. Fundamental importance exists where the dispute is capable of clarifying a legal question of general significance that is decisive for the case and not yet sufficiently clarified. This may also be the case where several parallel revision proceedings concern the same unresolved issues. Consideration 1 emphasizes that questions regarding compensatory overtime in the form of standby duty, including in foreign service, warrant review by the Federal Administrative Court.
