Resumo Omnilex

The Federal Administrative Court admitted the plaintiff’s revision. It held that the case raises issues of fundamental importance under § 132(2) No. 1 VwGO concerning compensation for overtime in the form of standby duty, in particular when the service was performed abroad. The court also noted that several parallel revision proceedings on the same subject were already pending before it.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance: Fundamental importance exists where the case is capable of clarifying unresolved questions of law that are relevant beyond the individual dispute. This may be the case where the legal assessment of compensatory overtime in the form of standby duty, especially in connection with service performed abroad, requires highest-court clarification. The existence of parallel pending revision proceedings may support the need for clarification and uniformity of case law (consid. 1).
