Resumo Omnilex

The Federal Administrative Court admitted the plaintiff’s revision. It held that the dispute raises questions of fundamental importance concerning compensatory time off for overtime in the form of standby duty, especially where the service was performed abroad. The court also pointed out that several further revision proceedings on the same topic were already pending before it.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admissibility of revision for fundamental importance. A revision is to be admitted where the case is capable of clarifying an unresolved and general legal question of significance beyond the individual dispute. Fundamental importance may be affirmed if the subject-matter concerns a broader, not yet settled legal issue, here the compensation of overtime by leisure time in the form of standby duty, in particular in the context of service performed abroad. The existence of parallel revision proceedings on comparable questions may corroborate the need for clarification (consid. 1).
