Resumo Omnilex

The Federal Administrative Court admitted the claimant’s revision because the case raises questions of fundamental significance concerning overtime to be compensated by time off in the form of standby duty, particularly for service rendered abroad. The court noted that several related revision proceedings were already pending. It also provisionally fixed the amount in dispute for the revision proceedings in accordance with the appellate court’s determination.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; revision is to be admitted where the case is capable of clarifying unresolved, general questions of law. Fundamental significance may exist in cases concerning compensation of overtime by time off, including standby duty and work performed abroad, especially where related proceedings are pending and the clarification sought extends beyond the individual dispute. The provisional amount in dispute for revision proceedings is to be fixed in accordance with the rules of the GKG and may follow the appellate court's valuation (consid. 1-2).
