This applies in particular where the compatibility of statutory objection-preclusion provisions with European Union law is disputed and has not been conclusively settled. Gründe

1 Die Beschwerde des Klägers gegen die Nichtzulassung der Revision in dem angefochtenen Urteil ist begründet. Die Rechtssache hat grundsätzliche Bedeutung im Sinne des § 132 Abs. 2 Nr. 1 VwGO. Sie wirft die erneut klärungsbedürftige Frage auf, ob die Bestimmungen über den Ausschluss von Einwendungen in § 10 Abs. 3 Satz 5 BImSchG und § 2 Abs. 3 UmwRG mit dem Recht der Europäischen Union vereinbar sind.

2 Die Festsetzung des Streitwerts beruht für das Beschwerdeverfahren auf § 47 Abs. 1 Satz 1 und Abs. 3, § 52 Abs. 1 GKG, für das Revisionsverfahren auf § 47 Abs. 1 Satz 1, § 52 Abs. 1, § 63 Abs. 1 GKG.
