Leitsatz

  1. NV: Hat das FG die Klage neben der Verneinung ihrer Zulässigkeit darüber hinaus für unbegründet erachtet, so muss zur Begründung der Nichtzulassungsbeschwerde hinsichtlich beider Gesichtspunkte ein Zulassungsgrund dargelegt werden.

  2. NV: Wird auch unter Verwendung vorhandener Bausubstanz eine Wohnung erstmals erstellt, kommt es nicht darauf an, ob die durchgeführten Baumaßnahmen bautechnisch zu einem Neubau geführt haben.

  3. NV: Das FG als Tatsachinstanz hat zu entscheiden, aufgrund welcher Umstände des Einzelfalls der Umbau eines Gebäudes dem Neuerrichten einer Wohnung gleichkommt.

  4. NV: Wer unter Verwendung vorhandener Bausubstanz zweier bereits existierender Wohnungen eine bisher nicht vorhandene dritte Wohnung erstellt, tätigt keine Baumaßnahmen "an" einem Gebäude.

Gründe

1 Die Nichtzulassungsbeschwerde ist unbegründet.

2 Im Streitfall muss nicht abschließend entschieden werden, ob das Finanzgericht (FG) die Zulässigkeitsfrage unrichtig beurteilt hat und ob in Bezug darauf Zulassungsgründe i.S. von § 115 Abs. 2 der Finanzgerichtsordnung (FGO) gemäß § 116 Abs. 3 Satz 3 FGO geltend gemacht wurden oder vorliegen. Denn unabhängig davon kann die Nichtzulassungsbeschwerde schon deshalb keinen Erfolg haben, weil das FG die Klage zugleich als unbegründet angesehen hat, diese Annahme die angefochtene Entscheidung eigenständig trägt und ihr gegenüber keine Gründe für eine Zulassung der Revision gegeben sind (vgl. Beschluss des Bundesfinanzhofs --BFH-- vom 9. März 2012 VI B 121/11, BFH/NV 2012, 1157, m.w.N.; Lange in Hübschmann/Hepp/Spitaler, § 95 FGO Rz 34, m.w.N.).

3 Die von der Klägerin und Beschwerdeführerin (Klägerin) geltend gemachten Zulassungsgründe einer grundsätzlichen Bedeutung der Rechtssache (§ 115 Abs. 2 Nr. 1 FGO) sowie des Erfordernisses einer Entscheidung des BFH (§ 115 Abs. 2 Nr. 2 FGO) liegen nicht vor. Nach höchstrichterlicher Rechtsprechung ist die von der Klägerin sinngemäß hervorgehobene Rechtsfrage, unter welchen Voraussetzungen der Umbau eines Gebäudes einem Neubau gleichkommt, hinreichend geklärt (vgl. etwa BFH-Urteil vom 24. Juni 2008 IX R 49/06, BFH/NV 2008, 1839). Wird auch unter Verwendung vorhandener Bausubstanz eine Wohnung erstmals erstellt, kommt es --entgegen der Beschwerdebegründung-- nicht darauf an, ob die durchgeführten Baumaßnahmen bautechnisch zu einem Neubau geführt haben (BFH-Urteil vom 29. Juni 2011 IX R 35/10, BFH/NV 2011, 1860).

4 Zum anderen hat das FG als Tatsacheninstanz zu entscheiden, aufgrund welcher Umstände des Einzelfalles der Umbau eines Gebäudes einem Neuerrichten der Wohnung gleichkommt. Eine solche einzelfallbezogene Beurteilung eines Streitfalles ist aber generell nicht grundsätzlich bedeutsam (BFH-Beschluss vom 23. August 2011 IX B 63/11, BFH/NV 2012, 53, m.w.N.). Entsprechend ist auch keine Entscheidung zur Fortbildung des Rechts erforderlich (§ 115 Abs. 2 Nr. 2, 1. Alternative FGO).

5 Die Vorentscheidung weicht auch nicht von den Entscheidungen des BFH ab, welche die Klägerin in ihrer Beschwerdebegründung benennt; vielmehr entspricht das Urteil des FG dieser Rechtsprechung. Es hat für den BFH nach § 118 Abs. 2 FGO bindend festgestellt, dass die Klägerin mit den Baumaßnahmen unter Verwendung der vorhandenen Bausubstanz zweier bereits existierender Wohnungen eine bisher nicht vorhandene dritte Wohnung erstellt hat und wegen bislang nicht vorhandener Sanitäreinrichtungen ein Funktionswechsel eingetreten sei. Damit handelt es sich nicht um eine Baumaßnahme "an" einem Gebäude (vgl. dazu BFH-Urteil in BFH/NV 2008, 1839, unter II. 2.).

6 Von einer weiteren Begründung sieht der Senat nach § 116 Abs. 5 Satz 2, 2. Halbsatz FGO ab.
