Leitsatz

NV: Die Gewährung von Kindergeld in einer bestimmten Höhe ist nach dem in Art. 20 Abs. 1 GG verankerten Sozialstaatsprinzip i.V.m. Art. 6 GG nicht geboten.

Gründe

1 Die Beschwerde ist unbegründet und durch Beschluss zurückzuweisen (§ 116 Abs. 5 Satz 1 der Finanzgerichtsordnung --FGO--).

2 1. Weder hat die Rechtssache grundsätzliche Bedeutung (§ 115 Abs. 2 Nr. 1 FGO) noch ist eine Entscheidung des Bundesfinanzhofs (BFH) zur Fortbildung des Rechts erforderlich (§ 115 Abs. 2 Nr. 2 Alternative 1 FGO).

3 a) Die von den Klägern und Beschwerdeführern (Kläger) sinngemäß aufgeworfene Rechtsfrage, ob aus verfassungsrechtlichen Gründen ein Anspruch auf Kindergeld in Höhe der in § 66 des Einkommensteuergesetzes in der Fassung des Familienleistungsgesetzes vom 22. Dezember 2008 (BGBl I 2008, 2955) geregelten Sätze für den Zeitraum vor dem 1. Januar 2009 besteht, ist durch die Rechtsprechung des BFH bereits geklärt.

4 Der Senat hat mehrfach entschieden, dass dem in Art. 20 Abs. 1 des Grundgesetzes (GG) verankerten Sozialstaatsprinzip i.V.m. Art. 6 GG kein Gebot zu entnehmen ist, Sozialleistungen in einer bestimmten Weise und einem bestimmten Umfang zu gewähren und jegliche die Familien treffenden Belastungen auszugleichen. Der Gesetzgeber ist lediglich verpflichtet, das nach sozialhilferechtlichen Kriterien zu ermittelnde Existenzminimum des Steuerpflichtigen und seiner Familie und ab dem Jahr 2000 zusätzlich einen Betreuungsbedarf im wirtschaftlichen Ergebnis von der Einkommensteuer freizustellen. Dementsprechend besteht kein Recht auf Kindergeld in einer bestimmten Höhe (Senatsbeschluss vom 26. August 2008 III B 153/07, BFH/NV 2008, 2009, m.w.N.).

5 b) Soweit die Kläger mit ihrem Vorbringen geltend machen, die steuerliche Freistellung des Existenzminimums von Kindern sei ab einem bestimmten Grenzsteuersatz nicht mehr gewährleistet, ist diese Rechtsfrage im konkreten Streitfall nicht klärbar. Denn eine Steuerfestsetzung ist nicht Gegenstand des vorliegenden Verfahrens.

6 2. Von einer Darstellung des Sachverhalts und von einer weiteren Begründung sieht der Senat nach § 116 Abs. 5 Satz 2 FGO ab.
