The applicant challenged the election of the Federal President and sought interim relief. Tenor

Das Ablehnungsgesuch gegen die Richterinnen Kessal-Wulf und König und den Richter Huber wird als unzulässig verworfen.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Damit erledigt sich der Antrag auf Erlass einer einstweiligen Anordnung.

Gründe

1 1. Das Ablehnungsgesuch ist offensichtlich unzulässig. Es enthält lediglich Ausführungen, die zur Begründung der Besorgnis der Befangenheit gänzlich ungeeignet sind. Angesichts der - dem Antragsteller offenbar bekannten - verfassungsgerichtlichen Rechtsprechung zur Ausgestaltung der Bundespräsidentenwahl war die völlige Aussichtslosigkeit des vorangegangenen Antrages auf Erlass einer einstweiligen Anordnung offensichtlich. Ein offensichtlich aussichtsloser Antrag ist jedoch auch im Verfahren über den Erlass einer einstweiligen Anordnung objektiv nicht eilbedürftig. Seine Ablehnung durch die Kammer im Verfassungsbeschwerdeverfahren ist entsprechend § 93d Abs. 1 Satz 3 BVerfGG auch nicht weiter begründungsbedürftig. Bei offensichtlicher Unzulässigkeit bedarf es keiner dienstlichen Stellungnahme der abgelehnten Richter. Diese sind auch von der Entscheidung über das offensichtlich unzulässige Ablehnungsgesuch nicht ausgeschlossen (vgl. BVerfGE 131, 239 <252 f.>; BVerfGK 8, 59 <60>).

2 2. Trotz der Bezeichnung als Wahlprüfungsbeschwerde ist die Eingabe als Verfassungsbeschwerde auszulegen, da eine Wahlprüfungsbeschwerde nach Art. 41 GG sich nur gegen einen im Wahlprüfungsverfahren ergangenen Beschluss des Bundestages richten kann (vgl. BVerfGE 2, 300 <305 f.>).

3 3. Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, weil sie unzulässig ist. Damit erledigt sich der Antrag auf Erlass einer einstweiligen Anordnung.

4 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

5 Diese Entscheidung ist unanfechtbar.
