The Federal Constitutional Court did not admit the constitutional complaint concerning search and seizure orders in a Cum/Ex tax investigation. It held that the challenged decisions of the Wiesbaden Regional Court, which had rejected complaints against the measures based on a statement of the Frankfurt General Prosecutor's Office, raised no constitutional concerns. In particular, the assumption of sufficient suspicion of especially serious joint tax evasion was not objectionable under the Basic Law.

In the context of Cum/Ex transactions, the assumption of particularly serious joint tax evasion may, on the basis of the case file and prosecutorial assessment, justify coercive investigative measures. The Federal Constitutional Court does not substitute its own assessment for that of the criminal courts unless the decision ignores the constitutional significance of the invaded rights or is otherwise arbitrary. No violation of the complainant's rights under Arts. 12, 13 or 103 GG was found (consid. tenor).

Tenor

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen. Sie ist unbegründet. Die angegriffenen Beschlüsse des Landgerichts, mit denen Beschwerden gegen Durchsuchungs- und Beschlagnahmeanordnungen im Zusammenhang mit Aktienkäufen über den Dividendenstichtag (so genannte Cum-/Ex-Geschäfte) unter Bezugnahme auf eine Stellungnahme der Generalstaatsanwaltschaft Frankfurt am Main vom 7. Februar 2013 als unbegründet verworfen werden, weil der Tatverdacht der besonders schweren mittäterschaftlichen Steuerhinterziehung gegeben sei, sind verfassungsrechtlich (Art. 103 Abs. 1, Art. 103 Abs. 2, Art. 13 Abs. 1 und 2, Art. 12 GG) nicht zu beanstanden.

Diese Entscheidung ist unanfechtbar.
