The Federal Constitutional Court repeated its earlier interim order and continued to prohibit the deportation of an asylum seeker to Afghanistan. The protection lasts for four additional months, but in any event no longer than until the constitutional complaint is decided. The decision is a procedural continuation of the prior interim relief and does not address the merits of the constitutional complaint.
Art. 32 Abs. 1 BVerfGG; repetition of an interim order in constitutional complaint proceedings; an existing provisional measure may be extended where this is necessary to avert irreversible disadvantages pending a decision on the merits. The duration may be limited to a fixed period and, alternatively, until the constitutional complaint is decided. The measure serves to secure effective judicial protection under Art. 19 Abs. 4 GG and is confined to provisional safeguarding; it does not prejudge the outcome of the main proceedings.
