Resumo Omnilex

The Federal Constitutional Court rejected the application for legal aid and appointment of counsel in a constitutional complaint challenging several OVG Lüneburg decisions concerning § 25 Abs. 5 AufenthG. The Chamber noted possible constitutional concerns about the lower courts’ treatment of tolerated stay periods, but held that the complaint was inadmissible because it did not sufficiently address all independently supporting reasons of the challenged decisions. The decision is final.

Sumário Omnilex

§ 93d Abs. 1 S. 3 BVerfGG; constitutional complaint admissibility and legal aid for intended constitutional review: legal aid is refused where the contemplated complaint lacks sufficient prospects of success. A constitutional complaint is inadmissible if the submission does not engage with all independently supporting grounds of the challenged decisions; it is not enough to attack only one of several self-standing reasons. Even if the Chamber entertains constitutional doubts as to a particular interpretation of ordinary law, the complaint may still fail for insufficient substantiation against alternative decisive reasons (consid. implicit in the tenor).

Titelzeile
