The Federal Constitutional Court did not accept the constitutional complaint filed by a biological father seeking contact with his child living in the household of the legal parents. The Court held that the complaint was inadmissible because it did not meet the substantiation requirements of §§ 23(1) sentence 2 and 92 BVerfGG. In particular, the complainant failed to address the Higher Regional Court's independent reason that contact would not serve the child's best interests due to the risk of loyalty conflicts in a highly strained family situation. The complaint also did not sufficiently show any constitutionally required procedural deficiency.

Mere general criticism or incomplete review of procedural objections does not satisfy the pleading burden. The Court may refrain from further reasoning under § 93d Abs. 1 sentence 3 BVerfGG.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Gründe

1 Die Verfassungsbeschwerde betrifft die Ablehnung des Antrags des biologischen Vaters nach § 1686a Abs. 1 Nr. 1 BGB auf Umgang mit seinem im Familienverband der rechtlichen Eltern lebenden Kind.

2 Die Verfassungsbeschwerde ist unzulässig, weil sie nicht den Anforderungen der § 23 Abs. 1 Satz 2, § 92 BVerfGG an eine hinreichend substantiierte Begründung genügt (zu den Substantiierungsanforderungen vgl. nur BVerfGE 89, 48 <60>; 155 <171>; 99, 84 <87>; 105, 252 <264>; 130, 1 <21> m.w.N.). Der Beschwerdeführer hat sich nicht mit der selbständig tragenden - verfassungsrechtlich unbedenklichen - Erwägung des Beschwerdegerichts auseinandergesetzt, dass mit Blick auf das hochgradig zerrüttete und belastete Verhältnis zwischen dem Beschwerdeführer und den (rechtlichen) Eltern zum Schutz des Kindes vor Loyalitätskonflikten die Kindeswohldienlichkeit von Umgängen mit dem leiblichen Vater nicht bejaht werden kann. Zudem lässt sich der Beschwerdebegründung nicht hinreichend entnehmen, dass verfassungsrechtlich gebotene verfahrensbezogene Anforderungen nicht beachtet wurden.

3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

4 Diese Entscheidung ist unanfechtbar.
