Resumo Omnilex

The Federal Constitutional Court rejected an application for interim relief aimed at lifting an existing civil guardianship. It held that the underlying constitutional complaint was inadmissible because the applicant had not exhausted ordinary remedies: a request for termination of guardianship had first to be made before the civil courts. In addition, the applicant did not substantiate that a constitutional complaint could still be filed within the one-month time limit, since the date of notification of the appellate decision was not shown.

Sumário Omnilex

§ 32 Abs. 1 BVerfGG; interim relief is inadmissible where the intended constitutional complaint is plainly inadmissible or manifestly unfounded. A challenge to the continuation of civil guardianship requires prior exhaustion of the ordinary remedy under § 1908d Abs. 1 BGB in conjunction with § 294 Abs. 1 FamFG. Moreover, where observance of the one-month period under § 93 Abs. 1 BVerfGG does not emerge from the file, the applicant must substantiate the date of notification in a coherent manner; absent such showing, the complaint cannot be treated as still capable of timely filing (consid. 2-4).

Titelzeile

Whether interim relief under § 32 BVerfGG should be granted to suspend the guardianship order.

Decisão extraída

The application for interim relief was denied because the intended constitutional complaint was plainly inadmissible.

Fundamentação extraída

Interim relief is unavailable where the underlying complaint is obviously inadmissible or manifestly unfounded. Here, the complaint failed for non-exhaustion of remedies and for lack of substantiated compliance with the constitutional complaint deadline.

Questão jurídica principal

Whether the applicant had exhausted ordinary remedies against the guardianship order.

Decisão extraída

No. The applicant had first to seek relief from the ordinary courts under the provisions on termination of guardianship.

Fundamentação extraída

A challenge to the continuation of guardianship must initially be pursued before the competent civil courts under § 1908d Abs. 1 BGB in conjunction with § 294 Abs. 1 FamFG. The applicant did not do so.

Questão jurídica principal

Whether timely filing of a constitutional complaint against the guardianship order was sufficiently shown.

Decisão extraída

No sufficient showing was made that a constitutional complaint could still be filed within the one-month period.

Fundamentação extraída

The applicant did not state when the appellate decision had been communicated, and the file did not otherwise reveal this. Without a plausible showing of the date of notice, compliance with § 93 Abs. 1 BVerfGG could not be established.
