The Federal Constitutional Court dismissed an election review complaint in written proceedings. It held that the complaint failed for the reasons already set out in the rapporteur’s letter of 5 April 2016 and, pursuant to § 26(3) sentence 3 EuWG in conjunction with § 24 sentence 2 BVerfGG, omitted any further reasoning.
§ 26 Abs. 3 S. 3 EuWG; § 24 S. 2 BVerfGG; election review complaint may be dismissed without further reasons when the complaint is unsuccessful and the Court refers to reasons previously communicated by the rapporteur. The Court may dispense with a detailed statement of reasons if the statutory conditions for abbreviated reasoning are met (consid. 1).
