The Federal Constitutional Court rejected an election review complaint by resolution. It stated that the complaint had no prospect of success for the reasons set out in the rapporteur's letter of 12 April 2016 and, pursuant to § 26(3) sentence 3 EuWG in conjunction with § 24 sentence 2 BVerfGG, declined to provide further reasoning.
§ 26 Abs. 3 S. 3 EuWG i.V.m. § 24 S. 2 BVerfGG; election review complaint may be rejected without further reasons when it is unfounded according to the grounds communicated by the rapporteur. The Federal Constitutional Court may dispense with a detailed statement of reasons if the complaint obviously lacks success and the statutory prerequisites for a summary dismissal are met.
