The Federal Constitutional Court rejected an applicant’s request for legal aid and for the issuance of an interim injunction. It held that the intended constitutional relief had no sufficient prospect of success and that interim constitutional protection was premature because the applicant had not yet exhausted the available emergency remedies before the ordinary courts under § 114 StVollzG. The decision was declared non-appealable.

Der Antrag auf Bewilligung von Prozesskostenhilfe und Beiordnung von Rechtsanwalt K… wird abgelehnt, weil die beabsichtigte Rechtsverfolgung keine hinreichende Aussicht auf Erfolg bietet.

Der Antrag auf Erlass einer einstweiligen Anordnung wird abgelehnt, da der Antragsteller die nach § 114 StVollzG bestehenden Möglichkeiten zur Erlangung fachgerichtlichen Eilrechtsschutzes bisher nicht ausgeschöpft hat (zur Subsidiarität der Verfassungsbeschwerde vgl.
