The Federal Constitutional Court rejected the election review complaint. It relied on the reasons already communicated in the rapporteur’s letter of 2016-01-26 and, pursuant to § 24 sentence 2 BVerfGG, refrained from providing any further reasoning.
§ 24 S. 2 BVerfGG; summary rejection of a complaint without further reasoning. Where the Court rejects an election review complaint on grounds previously communicated by the rapporteur, it may dispense with an extended statement of reasons. The provision permits an abbreviated dismissal when the complaint manifestly lacks prospects of success and the decisive reasons have already been conveyed to the complainant; no separate discussion is then required.
