The Federal Constitutional Court dismissed an election review complaint in chamber proceedings. It stated that the complaint could not succeed for the reasons set out in the rapporteur’s letter of 23 February 2016 and, under § 24 sentence 2 BVerfGG, waived any further reasoning.
§ 24 Satz 2 BVerfGG; summary dismissal of an election review complaint without further reasons. Where a constitutional complaint or similar remedy is manifestly without prospect of success, the Court may reject it by brief order and refer to the reasons previously communicated by the rapporteur; under § 24 sentence 2 BVerfGG, further reasoning may be omitted.
