The First Chamber of the First Senate of the Federal Constitutional Court refused to admit a constitutional complaint challenging occupation-related expropriation and the exclusion of restitution. The Court held that the complaint lacked fundamental constitutional significance and that admission was not required to enforce the rights invoked. It found no apparent violation of fundamental rights or equivalent rights on the basis of the submissions, especially in view of existing case law. The decision is final and non-appealable.

1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, weil die Voraussetzungen dafür nicht vorliegen (§ 93a Abs. 2 BVerfGG). Der Verfassungsbeschwerde kommt keine grundsätzliche verfassungsrechtliche Bedeutung zu. Die Annahme der Verfassungsbeschwerde ist auch nicht zur Durchsetzung der als verletzt bezeichneten Verfassungsrechte angezeigt (§ 93a Abs. 2 Buchstabe b BVerfGG). Auf der Grundlage des Vorbringens der Verfassungsbeschwerde ist die Möglichkeit einer Verletzung von Grundrechten oder grundrechtsgleichen Rechten - insbesondere im Blick auf die bereits vorliegende Rechtsprechung des Bundesverfassungsgerichts - nicht ersichtlich (vgl. BVerfGE 94, 12 <33>; BVerfG, Beschluss der 3. Kammer des Ersten Senats vom 5. Dezember 2012 - 1 BvR 336/09 -, juris).
