Resumo Omnilex

The Federal Constitutional Court dismissed an election complaint. It held that the complaint lacked success for the reasons set out in the rapporteur’s letter of 2015-12-29 and, under § 24 sentence 2 BVerfGG, dispensed with any further reasoning.

Sumário Omnilex

§ 24 Satz 2 BVerfGG; election complaint dismissed without further reasons. Where the Court concludes that a Wahlprüfungsbeschwerde has no prospect of success for the reasons previously communicated by the rapporteur, it may reject the complaint without issuing a detailed statement of reasons. The abbreviated form of decision is permissible when the statutory prerequisites are met; a further elaboration of the merits is then unnecessary (consid. 1).
