Resumo Omnilex

The applicant sought an interim order before the Federal Constitutional Court. The chamber first rejected recusal motions against Judges Landau, Kessal-Wulf, and König as inadmissible because they contained no grounds capable of substantiating bias. It then denied the request for interim relief, holding that the applicant had not adequately shown that the yet-to-be-filed main action would be admissible and not manifestly unfounded. The decision is final.

Sumário Omnilex

§ 19, § 23 Abs. 1 S. 2, § 32 Abs. 1 BVerfGG; requirements for recusal motions and interim constitutional relief: motions to recuse are inadmissible if they rest solely on arguments manifestly incapable of supporting a concern of bias. Interim relief under § 32 Abs. 1 BVerfGG requires the applicant to substantiate, at least summarily, that the anticipated principal application is neither inadmissible nor manifestly unfounded; otherwise the request must be rejected (consid. 1-2).

Titelzeile

September 2015 - 2 BvQ 29/15 -, juris).

Diese Entscheidung ist unanfechtbar.

The recusal motions were inadmissible because they relied only on arguments wholly unsuitable to justify an apprehension of bias.

Fundamentação extraída

The motions lacked any legally relevant facts capable of supporting a fear of bias; they were therefore not properly founded.

Questão jurídica principal

Whether interim relief under Section 32 BVerfGG should be granted

Decisão extraída

The application for interim relief was denied because the applicant did not substantiate that the anticipated main application would be neither inadmissible nor manifestly unfounded.

Fundamentação extraída

A successful interim application requires a sufficiently substantiated showing of the main application’s prospects; that threshold was not met here.
