Resumo

The Federal Constitutional Court did not admit the complainant’s constitutional complaint. It held that the complaint was inadmissible because the complainant had failed to exhaust legal remedies properly. In particular, an Anhörungsrüge would, from an objective perspective, have been capable of correcting the alleged fundamental-rights violation. The decision is final.

§ 90 Abs. 2 S. 1 BVerfGG; admissibility of a constitutional complaint despite omitted Anhörungsrüge: Legal remedies are not exhausted if an available Anhörungsrüge could, on objective assessment, have led to correction of the alleged violation. Exhaustion requires use of such a remedy before filing the constitutional complaint; the omission renders the complaint inadmissible (cf. BVerfGE 134, 106 <115>).

Tenor

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen, da sie unzulässig ist. Die Beschwerdeführerin hat den Rechtsweg nicht ordnungsgemäß erschöpft (vgl. § 90 Abs. 2 Satz 1 BVerfGG), da die Erhebung einer Anhörungsrüge bei objektiver Betrachtung zur Korrektur des gerügten Grundrechtsverstoßes hätte führen können (vgl. BVerfGE 134, 106 <115>).

Diese Entscheidung ist unanfechtbar.
