The Second Chamber of the Second Senate of the Federal Constitutional Court declined to admit the constitutional complaint. It held that, insofar as the complainant relied on an alleged violation of the European Convention on Human Rights, the legal remedies had not been properly exhausted. The decision was issued as an unreasoned chamber order and is final.

§ 90 Abs. 2 S. 1 BVerfGG; a constitutional complaint is inadmissible insofar as the complainant invokes an alleged violation of the European Convention on Human Rights without having properly exhausted the ordinary legal remedies in respect of that contention (cf. BVerfGE 112, 50 <62>; 129, 78 <93>). In such a case, non-admission may be ordered by chamber under § 93d Abs. 1 S. 3 BVerfGG without reasons.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen; insbesondere hat der Beschwerdeführer, soweit er sich zur Begründung einer behaupteten Grundrechtsverletzung auf einen Verstoß gegen die Europäische Menschenrechtskonvention beruft, den Rechtsweg nicht ordnungsgemäß erschöpft (vgl. BVerfGE 112, 50 <62>; 129, 78 <93>).

Diese Entscheidung ist unanfechtbar.
