Resumo Omnilex

The Federal Constitutional Court did not admit the constitutional complaint. The challenge to the urgent order of 2011-03-22 was time-barred, and the request for reinstatement did not sufficiently explain why the complainant was without fault. As to the merits decisions, the Court left open whether reinstatement could be granted, because the request concerned only late transmission of the seven-page complaint and could not cure the lack of timely substantiation. The complaint did not allow a preliminary constitutional assessment within the filing period, since key materials were missing or submitted too late.

Sumário Omnilex

§ 23 Abs. 1 sentence 2, § 92, § 93 Abs. 1 sentence 1 and § 93 Abs. 2 BVerfGG; admissibility of a constitutional complaint and requirements for reinstatement and substantiation: A constitutional complaint must be substantiated within the filing period by timely submission or sufficiently detailed reproduction of the challenged decisions and all documents necessary for a preliminary constitutional review. Reinstatement under § 93 Abs. 2 BVerfGG requires a concrete showing that the deadline was missed without fault and must relate to the specific procedural default concerned; a request limited to late transmission of the complaint document cannot remedy a lack of timely substantiation. If the complaint is already inadmissible for failure to meet substantiation requirements, the question of reinstatement may remain open (consid. 2-4).

Titelzeile

Whether the complaint against the order of 2011-03-22 was admissible despite expiry of the constitutional complaint deadline and the pending request for reinstatement.

Decisão extraída

The complaint was inadmissible because the deadline had been missed; reinstatement was irrelevant and, in any event, insufficiently substantiated as to absence of fault.

Fundamentação extraída

The Court held that even if effective judicial protection can be affected in urgent disciplinary enforcement matters, the complaint was filed too late. The reinstatement request did not clearly cover the expired deadline and did not explain why there was no procedural fault.

Questão jurídica principal

Whether the complaint against the decisions on the merits was admissible in light of the reinstatement request.

Decisão extraída

The complaint remained inadmissible because the reinstatement request related only to transmission of the seven-page complaint, not to the constitutional filing deadline itself.

Fundamentação extraída

Reinstatement can only cure the procedural default it actually concerns. Since the stated reasons addressed only the late transmission of the complaint itself, they could not save the complaint from inadmissibility caused by insufficient substantiation within the deadline.

Questão jurídica principal

Whether the constitutional complaint was sufficiently substantiated within the filing period.

Decisão extraída

No; the complaint did not enable even a preliminary constitutional review because the challenged decisions and necessary underlying materials were not timely submitted or reproduced in sufficient detail.

Fundamentação extraída

A constitutional complaint must, within the filing period, provide the Court with the challenged decisions and enough content of the relevant motions and materials to assess admissibility and merits. Here the reasons for the regional court decision were not reproduced adequately, and the annexes arrived only after the deadline.
