Resumo Omnilex

The Federal Constitutional Court again repeated an interim order in a family-law constitutional complaint concerning participation in a paternity test by buccal swab. It held that the disadvantages of immediate examination, especially the risk of disturbing or destroying the social-family relationship, outweighed the disadvantages that would arise if the constitutional complaint later succeeded. The prior interim order was therefore renewed for six months, but no longer than until the main constitutional complaint is decided.

Sumário Omnilex

Art. 32 Abs. 1, Abs. 6 S. 2 BVerfGG; Art. 6 Abs. 2 S. 1 GG; interim relief in constitutional complaint proceedings concerning a paternity test by buccal swab may be repeated if, upon weighing the consequences, the disadvantages of performing the examination immediately and thereby potentially impairing or destroying the social-family relationship outweigh the disadvantages that would arise if constitutional relief were later granted. The decisive criterion is a forward-looking balancing of consequences; where the status quo would be irreversibly altered, heightened weight attaches to the protection of family relations (consid. not stated).
