The Federal Constitutional Court, 2nd Senate, 1st Chamber, did not accept the constitutional complaint for decision in a non-reasoned chamber order. As a result, the accompanying request for an interim injunction was no longer to be decided separately. The order is final and not subject to appeal. Prior proceedings included decisions by the Regional Court Darmstadt and the Federal Court of Justice.
§ 93d Abs. 1 S. 3 BVerfGG; non-admission of a constitutional complaint in chamber proceedings: where the chamber declines to accept a constitutional complaint for decision, the complaint is terminated without a reasoned ruling. Ancillary applications for interim relief fall away as a consequence and are rendered moot; they are not to be decided independently once the main constitutional complaint is not admitted. The order is final and not subject to further appeal.
