Resumo Omnilex

The Federal Constitutional Court did not admit the constitutional complaint. It held that the requirements of § 93a Abs. 2 BVerfGG were not met because the complaint raised no question of fundamental constitutional importance and had no prospect of success. On the complainant's submissions, there were no indications that the challenged civil judgments of the OLG Karlsruhe and the BGH violated the invoked constitutional rights. The Court also dispensed with further reasoning under § 93d Abs. 1 sentence 3 BVerfGG.

Sumário Omnilex

§ 93a Abs. 2 BVerfGG; non-admission of a constitutional complaint for lack of fundamental constitutional significance and because there is no prospect of success. The Court admits a complaint only where one of the statutory admission grounds is met. If the pleadings do not disclose any indication of a possible violation of constitutional rights, the complaint is not to be admitted. Under § 93d Abs. 1 sentence 3 BVerfGG, the Court may refrain from further reasons in such summary non-admission orders.

Titelzeile
