The Federal Constitutional Court refused to admit a constitutional complaint against Federal Court of Justice decisions in a civil cassation case. It held that the complaint lacked prospects of success: the complainant had received sufficient hearing in the revision proceedings, and the Federal Court of Justice had neither violated the judge guarantee by acting as a fact-finding instance nor exceeded the limits of judicial law development. Gründe

1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, weil die Voraussetzungen dafür nicht vorliegen (§ 93a Abs. 2 BVerfGG). Der Verfassungsbeschwerde kommt keine grundsätzliche verfassungsrechtliche Bedeutung zu. Ihre Annahme ist auch nicht zur Durchsetzung der Grundrechte und grundrechtsgleichen Rechte der Beschwerdeführerin angezeigt; denn sie hat keine Aussicht auf Erfolg. Anhaltspunkte dafür, dass die angegriffenen Entscheidungen gegen die als verletzt gerügten verfassungsmäßigen Rechte der Beschwerdeführerin verstoßen könnten, sind auf der Grundlage des Vorbringens der Verfassungsbeschwerde nicht ersichtlich.

2 Der Beschwerdeführerin ist in der Revisionsinstanz das rechtliche Gehör hinreichend gewährt worden (Art. 103 Abs. 1 GG). Dies lässt sich den mit der Verfassungsbeschwerde vorgelegten Anlagen entnehmen. Der Bundesgerichtshof hat sich nicht unter Verstoß gegen Art. 101 Abs. 1 Satz 2 GG Befugnisse einer Tatsacheninstanz angemaßt. Das ergibt sich ohne weiteres im Blick auf die Gründe des Berufungsurteils, die der Bundesgerichtshof in seiner Entscheidung aufgegriffen hat. Er hat auch nicht die verfassungsrechtlichen Grenzen richterlicher Rechtsfortbildung überschritten. Deshalb kann dahingestellt bleiben, inwieweit sich die Beschwerdeführerin als Gesellschaft ausländischen Rechts mit Sitz in den Vereinigten Staaten von Amerika unter diesem Aspekt überhaupt auf eine Verletzung eigener verfassungsmäßiger Rechte berufen könnte (vgl. Art. 19 Abs. 3 GG; BVerfGE 21, 207 <208 f.>; 23, 229 <236>; 100, 313 <364>; BVerfG, Beschluss der 2. Kammer des Ersten Senats vom 27. 3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.
