The Federal Constitutional Court did not admit the constitutional complaint. It held that the challenge to the Cologne Regional Court decisions was time-barred because the complainant knew of the decisive order by 2010-09-08 at the latest, and a second hearing complaint could not keep the one-month filing period open because it was manifestly inadmissible. In addition, the alleged violation arising from the Regional Court's inactivity was not sufficiently substantiated. The Court dispensed with further reasoning and stated that the decision is not subject to appeal.

Independently thereof, a constitutional complaint must substantiate the alleged violation of rights with the required specificity under §§ 23(1) sentence 2 and 92 BVerfGG; a bare allegation of judicial inactivity is insufficient (consid. 6).

1 Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen. Die Voraussetzungen für eine notwendige Annahme (§ 93a Abs. 2 BVerfGG) liegen nicht vor; die Annahme ist auch im Übrigen nicht angezeigt.

2 1. Soweit sie sich gegen die angegriffenen gerichtlichen Entscheidungen richtet, ist die Verfassungsbeschwerde unzulässig, da sie nicht innerhalb der Beschwerdefrist des § 93 Abs. 1 Satz 1 BVerfGG erhoben wurde.

3 a) Der die erste Anhörungsrüge der Beschwerdeführerin als unbegründet zurückweisende Beschluss des Landgerichts vom 24. August 2010 war der Beschwerdeführerin spätestens seit dem 8. September 2010 bekannt, wie die an diesem Tag erhobene erneute Anhörungsrüge zeigt. Die Beschwerdefrist lief damit spätestens am 8. Oktober 2010 ab und ist durch die erst am 16. März 2011 beim Bundesverfassungsgericht eingegangene Verfassungsbeschwerde ersichtlich nicht gewahrt.

4 b) Die erneute Anhörungsrüge vom 8. September 2010 kann die Beschwerdefrist nicht offen halten, da sie offensichtlich unzulässig ist (vgl. BVerfGK 11, 203 <205>).

5 Eine erneute Anhörungsrüge gegen einen Beschluss, mit dem eine Anhörungsrüge als unbegründet zurückgewiesen wird, ist einfachrechtlich unstatthaft (vgl. Bayerischer Verfassungsgerichtshof, Entscheidung vom 19. Oktober 2010 - Vf. 111-VI-09 -, juris; BVerwG, Beschluss vom 16. April 2007 - 7 B 3/07 -, juris; BFH, Beschluss vom 2. Juni 2008 - VII S 19/08, BFH/NV 2008, S. 1687) und damit offensichtlich unzulässig im obigen Sinn.

6 2. Im Übrigen ist die Verfassungsbeschwerde unzulässig, weil die Beschwerdeführerin die von ihr behauptete Verletzung ihrer Rechte durch die Untätigkeit des Landgerichts nicht substantiiert dargelegt hat (§ 23 Abs. 1 Satz 2, § 92 BVerfGG).

7 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

8 Diese Entscheidung ist unanfechtbar.
