The Federal Constitutional Court did not admit the constitutional complaint against Article 1 of the Act to Combat Child Pornography in Communication Networks. It held that the submission failed to meet the substantiation requirements of § 23(1) sentence 2 half-sentence 1 and § 92 BVerfGG and that subsidiarity under § 90(2) sentence 1 BVerfGG also barred the application. The Court dispensed with further reasons under § 93d(1) sentence 3 BVerfGG. The decision is final and not subject to appeal.

Eine Verfassungsbeschwerde muss die behauptete Grundrechtsverletzung und deren verfassungsrechtliche Herleitung hinreichend substantiiert darlegen; bloße pauschale oder nicht tragfähige Rügen genügen nicht (vgl. Rn. 1). Zudem ist der Grundsatz der Subsidiarität zu beachten: Vor Anrufung des Bundesverfassungsgerichts sind grundsätzlich alle zumutbaren fachgerichtlichen oder sonstigen Möglichkeiten zur Abhilfe auszuschöpfen. Fehlt es daran, ist die Verfassungsbeschwerde bereits unzulässig und ihre Annahme abzulehnen; eine weitergehende Begründung kann nach § 93d Abs. 1 Satz 3 BVerfGG unterbleiben.

1 Die Verfassungsbeschwerde ist unzulässig, weil sie nicht den Begründungsanforderungen gemäß § 23 Abs. 1 Satz 2 Halbsatz 1 und § 92 BVerfGG genügt und ihr der Grundsatz der Subsidiarität gemäß § 90 Abs. 2 Satz 1 BVerfGG entgegensteht.

2 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

3 Diese Entscheidung ist unanfechtbar.
