Resumo Omnilex

In a constitutional complaint concerning paternity-determination measures, the Federal Constitutional Court repeated its earlier interim order. The order of 7 October 2010, which suspended enforcement and required the applicant to tolerate investigative measures, was extended for a further six months, at the latest until the main complaint is decided.

Sumário Omnilex

§ 32 Abs. 6 S. 2 BVerfGG; repetition of an interim order pending constitutional review: where provisional relief has been granted in constitutional complaint proceedings and the need for protection continues, the Court may extend the interim arrangement for a limited period until the merits decision. In family-law paternity proceedings, the provisional balance may include both suspension of enforcement and the duty to tolerate investigative measures; the measure remains strictly temporary and may be repeated only so long as the main proceedings have not been decided.
