The First Chamber of the First Senate of the Federal Constitutional Court did not admit the constitutional complaint. The complaint was inadmissible because the complainant had not exhausted legal remedies: after the BGH set aside the appellate judgment and remitted the case, further proceedings before the court of appeal remained possible. The Court noted that the binding effect of the remand judgment does not itself satisfy exhaustion, unless success before the ordinary courts is impossible. It added that, even if admissible, the complaint would fail on the merits because no objectively arbitrary application of law by the BGH was discernible.

Gründe

1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, weil die Annahmevoraussetzungen des § 93a Abs. 2 BVerfGG nicht vorliegen.

2 Die Verfassungsbeschwerde ist unzulässig. Sie wurde zwar fristgemäß begründet, weil sie den Gehalt der angegriffenen Entscheidung hinreichend referierte. Ihre Zulässigkeit scheitert aber daran, dass der Beschwerdeführer den Rechtsweg nicht erschöpft hat (§ 90 Abs. 2 Satz 1 BVerfGG).

3 In der Rechtsprechung des Bundesverfassungsgerichts ist geklärt, dass der Rechtsweg grundsätzlich nicht erschöpft ist, wenn

  • wie hier - das Revisionsgericht die Sache an das Berufungsgericht zurückverweist (vgl. BVerfGE 8, 222 <225>; 78, 58 <67 f.>; BVerfG, Beschluss der 2. Kammer des Ersten Senats vom 28. August 2000 - 1 BvR 2328/96 -, NJW 2001, S. 216 <217>; Beschluss der 2. Kammer des Ersten Senats vom 22. April 2009 - 1 BvR 386/09 -, NJW 2009, S. 2945 Rn. 13; Beschluss der 2. Kammer des Ersten Senats vom 14. September 2009 - 1 BvR 1993/09 -, NZS 2010, S. 322 Rn. 2; Beschluss der 3. Kammer des Ersten Senats vom 16. November 2009 - 1 BvR 2545/09 -, juris, Rn. 2). An einer mangelnden Erschöpfung des Rechtswegs ändert die Bindungswirkung des Revisionsurteils grundsätzlich nichts (vgl. BVerfGE 8, 222 <225>; BVerfG, Beschluss der 2. Kammer des Ersten Senats vom
  1. August 2000 - 1 BvR 2328/96 -, NJW 2001, S. 216 <217>; Beschluss der 2. Kammer des Ersten Senats vom 22. April 2009 - 1 BvR 386/09 -, NJW 2009, S. 2945 Rn. 13; Beschluss der 2. Kammer des Ersten Senats vom 14. September 2009 - 1 BvR 1993/09 -, NZS 2010, S. 322 Rn. 2). Eine Ausnahme gilt nur dann, wenn der Beschwerdeführer im weiteren fachgerichtlichen Verfahren mit seinem Begehren keinen Erfolg mehr haben kann (vgl. BVerfGE 78, 58 <68>; BVerfG, Beschluss der 2. Kammer des Ersten Senats vom 28. August 2000 - 1 BvR 2328/96 -, NJW 2001, S. 216 <217>; Beschluss der 2. Kammer des Ersten Senats vom 22. April 2009
  • 1 BvR 386/09 -, NJW 2009, S. 2945 Rn. 13; Beschluss der 2. Kammer des Ersten Senats vom 14. September 2009 - 1 BvR 1993/09 -, NZS 2010, S. 322 Rn. 3; Beschluss der 3. Kammer des Ersten Senats vom 16. November 2009 - 1 BvR 2545/09 -, juris, Rn. 3). Ein Erfolg des Beschwerdeführers ist indessen im konkreten Fall nach Aufhebung des Berufungsurteils und Zurückverweisung der Sache an das Berufungsgericht nicht ausgeschlossen.

4 Im Übrigen wäre die Verfassungsbeschwerde - ihre Zulässigkeit unterstellt - auch in der Sache aussichtslos, weil eine unvertretbare und damit objektiv willkürliche Rechtsanwendung durch den Bundesgerichtshof nicht erkennbar ist.

5 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

6 Diese Entscheidung ist unanfechtbar.
