Resumo Omnilex

The Federal Constitutional Court held that an election review complaint was inadmissible because the required supporting declarations from at least 100 eligible voters did not include the signatories' dates of birth. The Court emphasized that this information is indispensable for verifying voting eligibility, especially the minimum-age requirement. Since the formal requirement in § 26(3) sentence 3 EuWG in conjunction with § 48(2) BVerfGG was not met, the complaint could not be entertained.

Sumário Omnilex

§ 26 Abs. 3 S. 2 und S. 3 EuWG, § 48 Abs. 2 BVerfGG; election review complaint based on supporting declarations: the date of birth of the signatory is a mandatory formal element and may not be dispensed with where it is necessary for verifying voting eligibility, in particular compliance with the minimum-age requirement under § 6 Abs. 1 S. 1 Nr. 1 and Abs. 3 S. 1 Nr. 1 EuWG. Supporting declarations lacking this information do not satisfy the statutory admissibility requirements and render the complaint inadmissible (consid. 1).

Whether the election review complaint was admissible despite supporting declarations lacking signatories' dates of birth.

Decisão extraída

No. The complaint was inadmissible because the supporting declarations did not satisfy the statutory formal requirements; the dates of birth could not be dispensed with.

Fundamentação extraída

The date of birth is essential for checking eligibility to vote, in particular the minimum-age requirement under the European Election Act and the Federal Constitutional Court Act. Without it, the signatories' eligibility cannot be properly verified.
